Travel Nurse Sick Days: How Paid and Unpaid Time Off Affects Stipends

By Sharon Ben-Moshe · September 15, 2026 · Updated October 17, 2026

Calling in sick during a travel nursing contract does more than reduce your hourly wages. It frequently triggers a significant reduction or clawback of your tax-free housing and meal stipends.

Travel nurse pay packages bundle taxable hourly wages with non-taxable weekly allowances. When you miss a scheduled 12-hour shift due to illness, agencies often prorate your weekly stipend, leaving you with a drastically smaller paycheck.

Why agencies prorate stipends when you call in sick

Staffing agencies bill hospitals based on the exact hours a nurse works on the unit. If you call in sick for a 12-hour shift on a 36-hour contract, the agency cannot bill the hospital for that shift.

Because the agency loses one-third of its billing revenue for that week, their contract terms typically dictate that they prorate your weekly lodging and meal stipends by one-third (or by the missed daily proportion).

However, from an IRS perspective under IRS Publication 463, your living expenses do not disappear because you were sick. You still pay for your hotel, apartment, or extended-stay room on the day you missed work.

State statutory paid sick leave vs federal per diem rules

Certain states, including California, Washington, Oregon, New York, and Massachusetts, legally mandate that employers provide paid sick leave to temporary workers based on accrued hours worked.

When you use mandated paid sick leave in these states, the agency pays you for your missed shift at your taxable hourly base rate. However, state sick leave laws do not require agencies to pay non-taxable travel stipends during sick time.

Some agencies attempt to recharacterize unpaid stipends as taxable sick pay, or deduct lodging costs from future paychecks. Review your agency employment agreement carefully before signing to understand their specific missed-shift stipend policy.

What to do if an agency wrongfully claws back stipends

If you were physically present at your assignment location and unable to work due to acute illness, you continued to incur duplicate lodging expenses.

Check your contract language to see if your agency offers a make-up shift provision. Working an extra shift during the same pay period or the subsequent week often restores your full weekly stipend entitlement.

Frequently asked questions

Can an agency deduct housing stipends when I call in sick?

Many staffing agency contracts prorate weekly stipends for missed shifts, even though you still incur duplicate lodging costs away from home. Review your contract terms carefully.

Do state paid sick leave laws require agencies to pay travel stipends?

No. State mandated paid sick leave laws require employers to replace taxable hourly wages, not non-taxable travel expense reimbursements.

Can I work a make-up shift to prevent stipend clawbacks?

Yes. If your hospital unit and agency agreement permit make-up shifts, working an alternate shift in the same pay period typically restores your full weekly stipend.
